Terms of Use and Disclaimer

Version 4 · Effective November 4, 2026

The short version: Open Seat Meet is a listing website only. We don't screen, verify, or background-check anyone, and we don't attend, organize, or supervise meetups. You decide who to meet and what to do, and you use Open Seat Meet and meet people entirely at your own risk. By using the site, posting a seat, or grabbing a seat, you agree to these Terms, including the release of claims, limits on our liability, and individual arbitration below.

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Open Seat Meet and its owners, operators, members, officers, employees, contractors, and affiliates (together, "Open Seat Meet," "we," "us"). They cover openseatmeet.com, any related pages, emails, and services (the "Site"). By using the Site, posting a meetup, or RSVPing to one, you agree to these Terms. If you don't agree, don't use the Site.

2. Who can use it

You must be at least 18 years old and able to enter a binding contract. You agree that the information you give us is true and that you'll keep it accurate. One person per account email; no posting on behalf of someone else without their permission.

3. What we are, and aren't

4. Use at your own risk

You understand and agree that meeting people you don't know involves risk, and you voluntarily assume all of it.

Risks include, without limitation: harm caused by other users, including physical injury, assault, harassment, theft, fraud, or emotional distress; injury during physical activities such as walks, runs, pickleball, and other sports, including sprains, fractures, heat illness, cardiac events, or death; food allergies, foodborne illness, and the effects of alcohol; accidents while traveling to or from a meetup; conditions at venues; and loss of or damage to property. You are solely responsible for deciding whether to meet anyone, where, when, and how, and for your own safety, health, and fitness for any activity. If you choose to drink alcohol, you do so at your own risk and must be of legal drinking age and never drive impaired.

5. Your responsibilities

6. Prices, refunds, and host fees

7. House rules

You agree not to: harass, threaten, stalk, discriminate against, or harm anyone; post false, misleading, or impersonating information; use the Site for sales pitches, recruiting, MLM, solicitation, or spam; post sexually explicit content or offer anything illegal; list a private residence; collect other users' information; or interfere with or misuse the Site. We may remove listings, cancel meetups, refuse service, or block anyone at any time, for any reason, without notice or liability.

8. Listings and content

You're responsible for everything you post. You give us a non-exclusive, royalty-free, worldwide license to display, copy, and share your listing content to operate and promote the Site. We don't review listings in advance and aren't responsible for user content. Statements by users are theirs, not ours.

9. No warranties

The Site and everything on it are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, safety, accuracy, availability, or that the Site will be error-free or secure. We make no warranty about any user, meetup, venue, or activity.

10. Limitation of liability

To the fullest extent permitted by law, Open Seat Meet will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any personal injury, bodily harm, death, emotional distress, property damage, or loss of data, profits, or goodwill, arising from or related to the Site, any meetup, any user's conduct, any venue, or any activity, even if we were advised of the possibility. Our total liability for all claims of any kind will not exceed the greater of (a) the fees you paid us in the 12 months before the claim or (b) $50.

Some jurisdictions don't allow certain limits, so some of these may not apply to you. In that case, our liability is limited to the smallest amount the law allows.

11. Release of claims

To the fullest extent permitted by law, you release, waive, and forever discharge Open Seat Meet from any and all claims, demands, damages, and liabilities of every kind, known and unknown, arising from or related to any meetup, any interaction with another user, any venue, or any activity, including claims of negligence.

If you're a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law in any other state.

12. Indemnification

You agree to defend, indemnify, and hold harmless Open Seat Meet from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your meetups, your content, your conduct toward other users, or your breach of these Terms or any law.

13. Disputes and arbitration

Please read this carefully. It affects your rights. Any dispute arising from or relating to these Terms or the Site will be resolved by final, binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. You and we waive any right to a jury trial and to bring or join any class, collective, or representative action. You may opt out of arbitration within 30 days of first using the Site by emailing us with "Arbitration opt-out" in the subject line. These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any matter not subject to arbitration will be brought only in the state or federal courts located in Chatham County, Georgia. Any claim must be filed within one year after it arises, or it's permanently barred.

14. Privacy

We collect what you give us (name, email, optional phone, intro, and listing details) and basic records of payments and check-ins. Your first name, bio, and listing are public. Your email and phone are shared only with the person you're matched with. We use Google services to store data and send email and calendar invites, and Stripe to process payments. We don't sell your personal information. We keep records, including your agreement to these Terms, as long as needed to run the Site, resolve disputes, and meet legal obligations. To ask about or delete your data, email us.

15. General terms

We may change these Terms at any time by posting a new version; continuing to use the Site means you accept the changes. We may suspend or end the Site or your access at any time. If any part of these Terms is unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver. You can't transfer these Terms; we can. These Terms are the entire agreement between you and us about the Site. Sections 3 through 15 survive any termination.
